IF, NOTWITHSTANDING THE ABOVE, WE ARE FOUND LIABLE, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED:
The amount you paid us in the twelve (12) months preceding the claim, OR

10. Indemnification
You agree to defend, indemnify, and hold harmless Psychedelic Safety Institute and its officers, directors, employees, agents, affiliates, successors, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:
Your use or misuse of the Services
Your violation of these Terms
Your violation of any law or regulation
Your violation of the rights of any third party
Your User Content
Your negligence or willful misconduct
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.
11. Term and Termination
11.1 Term
These Terms remain in effect while you use the Services.
11.2 Termination by You

11.3 Termination by Us
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you:

Engage in prohibited conduct
Provide false or misleading information
Violate applicable laws
Engage in conduct harmful to us or other users
11.4 Effect of Termination
Upon termination:
Your right to use the Services ceases immediately
We may delete your account and data (subject to our retention obligations)
Provisions intended to survive termination will continue in effect

12. Dispute Resolution
12.1 Informal Resolution
Before filing a claim, you agree to contact us at hello@psychedelicsafety.institute to attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations for at least thirty (30) days.
12.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of California, United States of America, without regard to its conflict of law provisions.
12.3 Jurisdiction and Venue
For users outside of arbitration agreements: You agree that any legal action or proceeding shall be brought exclusively in the federal or state courts located in the United States of America, California, and you consent to personal jurisdiction and venue in such courts.
12.4 Arbitration (Optional - Include if desired)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by American Arbitration Association under its rules.
Terms of Arbitration:
Arbitration will be conducted in California
The arbitrator's decision is final and binding
You and we each pay our own arbitration costs
Arbitration is on an individual basis (no class actions)
Exceptions: The following disputes are not subject to arbitration:
Small claims court actions (if requirements are met)
Injunctive or equitable relief to protect intellectual property rights
Disputes that cannot lawfully be arbitrated
Opt-Out: You may opt out of arbitration by sending written notice to hello@psychedelicsafety.institute within thirty (30) days of first accepting these Terms.
Class Action Waiver: You agree that disputes will be resolved on an individual basis. You waive the right to participate in a class action, class arbitration, or representative action.
12.5 Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND PSYCHEDELIC SAFETY INSTITUTE WAIVE THE RIGHT TO A TRIAL BY JURY.
12.6 Time Limitation
You agree that any claim arising out of or related to the Services must be filed within one (1) year after such claim arose; otherwise, the claim is permanently barred.
13. General Provisions
13.1 Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Psychedelic Safety Institute regarding the Services and supersede all prior agreements and understandings.
13.2 Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by:
Posting the updated Terms with a new "Last Updated" date
Displaying a prominent notice on our Services
Sending email notification (for registered users)
Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Services.

13.6 No Third-Party Beneficiaries
These Terms do not confer any third-party beneficiary rights.
13.7 Force Majeure
We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor disputes, or internet/telecommunications failures.
13.8 Interpretation
Headings are for convenience only and do not affect interpretation
"Including" means "including but not limited to"
Singular includes plural and vice versa
"Or" is not exclusive
13.9 Language
These Terms are drafted in English. If translated, the English version shall prevail in case of any inconsistency or dispute.
13.10 Export Controls
You agree to comply with all applicable export and import control laws and regulations. You represent that you are not located in a country subject to embargo or designated as a "terrorist supporting" country, and that you are not on any government prohibited or restricted party list.
13.11 Government Users
If you are a U.S. government entity, the Services are "commercial computer software" and "commercial computer software documentation" as defined in Federal Acquisition Regulations, and you have only those rights specified in these Terms.

Notices to You: We may provide notices to you by email (to your registered email address), by posting on our Services, or by other legally acceptable means.

15. Feedback and Suggestions
